BADAL HAJI, MENERIMA IMBALAN DARI MELEMPAR JUMRAH DAN HAJI DENGAN PASPOR HIJAU

Question:

1. About Hajj Badal

Someone who already perform the pilgrimage, on the next pilgrimage season he performed the pilgrimage again. In the group there is a friend who asks for help to him so menghajikan his wife who died some time before leaving for the pilgrimage, as for compensation or badalnya form of money. My question is;

a. Are people who have been allowed to perform the pilgrimage receive an assistant Haj and why?

b. If money is lost if the substitute was accepted hajj for him? Could it be all the reward Hajj returned to his deceased wife?

c. Are men allowed to be representative of women's hajj pilgrimage or substitute it must be the same gender with which replaced?

2. Receiving benefits jumrah throwing in Mina

In the town of Mina Hajj season is very hot and crowded by jama'ah pilgrimage. Indonesian Haj Jama placed on the opposite hill by going through the tunnel. After throwing on the first day, then on the second day onwards we jama'ah many who feel tired, especially women and jama'ah jama'ah pilgrimage that elders. How does the law if in one group there is a pilgrimage jama'ah who is fluent in Arabic and then was told by the head of his group to buy a goat for a pilgrimage jama'ah tamatu 'whose numbers 14 people. The price of a 300 Rial Saudi goats. Having reached the point of sale and sacrifice goats Dam, there were also sold one cow with its tail price 1800 Saudi Rial. Without permission jama'ah, people who were told earlier not buying the goat but to buy two cows with a record of one cow for 7 people jama'ah. Thus he has the advantage of 7 300 Rial jama'ah or 600 people from 14 jama'ah Rial. Whether the excess money that may be taken by delegates without the knowledge itutadi jama'ah?

4. Go for Hajj with Green Passport

How to perform the pilgrimage with his legal green passport / passport common. For when viewed from the side he had violated immigration laws, whether the pilgrimage with the green passport diterirna by Allah SWT? Because a person with a green passport itubisa go to the holy land during Ramadan and return to their homeland in the early Muharam. Thus he was satisfied to worship in the holy land than jama'ah departing with ONH.


Answer:

1. Hajj Badal

a. According to scholars Syafi'iyah children even other people to perform Hajj on behalf of their parents or others. Implementation of such a pilgrimage called Hajj pilgrimage mandate or substitute. Ulama Muhammadiyah Legal Affairs Committee believes that the substitute pilgrimage can only be done by children against their parents, either father or mother who has been obliged to the Hajj, but because of senility or death, his parents were not able to pilgrimage. The substitute pilgrimage undertaken by other children, according to Muhammadiyah schools should not be. This is because there are the verses of the Koran that can be understood that a person will only get a reward from the results of its own and he can not do worship for other people, the reward of worship that remains for people who do not for others. This is for instance as mentioned in Surat al-Baqarah verse 286:

 

لَهَا مَا كَسَبَتْ وَعَلَيْهَا مَا اكْتَسَبَتْ [البقرة (2): 286]

 

It means: "... he got a reward (of virtue) is earned and he got a punishment (of crime) has earned ..."

Similarly, a letter an-Najm verse 38-39:

 

أَلَّا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَىٰ

وَأَن لَّيْسَ لِلْإِنسَانِ إِلَّا مَا سَعَىٰ

 

 [38-39(53):النجم]

 

It means: "(ie), Behold a wicked person will not bear the sins of others. And that a man no gain other than what has been earned. "

Meanwhile, there are traditions of the Prophet, explaining that the child can perform the pilgrimage to her parents who were elderly or had died. Among others mentioned in the history of Ibn Jama Hibban:

 

أَنَّ امْرَأَةً مِنْ خَثْعَمٍ قَالَتْ يَا رَسُولَ اللَّهِ إِنَّ أَبِي أَدْرَكَتْهُ فَرِيضَةُ الْحَجِّ وَهُوَ شَيْخٌ كَبِيرٌ لَا يَسْتَطِيعُ أَنْ يَسْتَوِيَ عَلَى ظَهْرِ الْبَعِيرِ قَالَ حُجِّي عَنْهُ [رواه الجماعة عن ابن حبان]

 

It means: "There was a lady from Khas'am said to the Prophet: O Messenger of Allah indeed my father until her liabilities haji when he was very old, he can not sit upright on the backs of camels, the Prophet said: hajikanlah him."

In the meantime there is also a Prophetic traditions which explain that the child is the result of his parents. This is as mentioned in the hadith narrated at-Tirmidhi, an-Nasa'i and Ibn Majah:

 

إِنَّ أَطْيَبَ مَا أَكَلْتُمْ مِنْ كَسْبِكُمْ وَإِنَّ أَوْلَادَكُمْ مِنْ كَسْبِكُمْ [رواه الترمذي والنسائى وابن ماجه]

 

It means: "Sesungguhnva the best that you eat is from yourselves, and indeed your children are of yourselves."

b. Therefore, the Muhammadiyah not allow substitute pilgrimage by other than his son, then the problems that Mr. money substitute as asked, nothing automatic. Only if the substitute was his son, who obtained a reward Hajj? In this case the reward for Hajj is the child who is a substitute, while the parents mernperoleh reward from the release of funds and obtain the reward of the good son.

c. Based on the hadith narrated by Ibn Jama Hibban above can be seen that women should menghajikan male (father) or men menghajikan women (his mother). Next please read guidance rituals of Hajj, the composition of the Legal Affairs Committee and Development Team of Islamic Thought PP Muhammadiyah, Annex V pages 26-37.

2. People who are unable to implement their own throw jumrah (due to illness, old, pregnant, weak and others) to depute to others. Based on the hadith Jabir:

 

حَجَجْنَا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَمَعَنَا النِّسَاءُ وَالصِّبْيَانُ فَلَبَّيْنَا عَنْ الصِّبْيَانِ وَرَمَيْنَا عَنْهُمْ[أخرجه ابن ماجه]

 

It means: "(Jabir said) We go for Hajj with the Messenger of Allah and with the women and children. We read Talbiah represent the children and throw jumrah represent them. "

Because there are no provisions regarding the limits of the represented, it is fine represents several people. With a record that represented each throw seven times for each jumrah. Regarding compensation, should the representative do not accept / ask for compensation, because of the pilgrimage are encouraged to help each other.

3. Envoy or representative who switched the purchase goats with cattle should need permission jama'ah. But perhaps to save time and energy (unlike the situation in Makkah in Indonesia), he took a shortcut, yet the same legal consequences because one cow may be for seven people). Given this condition jama'ah should give up the goat problem with purchasing replacement cattle. Regarding the excess money, because she as a messenger / representative, shall be returned to jama'ah. If he is not as a messenger, but as the excess money brokers may be taken. However, if jama'ah mengikhlaskannya it better and the excess money it is lawful.

4. In syar'i if requirements are met then the Hajj valid rukunnya. But as a Muslim and a good citizen, is also required to abide by the rules set by the government in order to benefit and good of its citizens. Because not a few people using a green passport stranded in Saudi Arabia.

Allah says:

 

يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنكُمْ[النساء (4): 59]

 

It means: "O ye who believe, obey Allah and obey the Apostle (His), and ulil amri among you."
